Spain’s rental decrees face an expected vote weeks before the 29 November election

One national rental decree is in force and another is due to start on 15 November, but both need approval from Congress’s standing committee, expected on 12 November according to press reports. Party promises are not law.

On 2 October Congress repealed Decree-law 26/2026, 172 votes for keeping it to 178 against, and 27/2026, 166 to 184. On 6 October, with Parliament dissolved, the government approved two replacements that Prime Minister Pedro Sánchez said keep their essence.

The vote

With Parliament dissolved, the Constitution gives the decision to Congress’s Diputación Permanente, a standing committee of 69 according to press reports, with the same legal effect. EFE reported on 27 October that 12 November is the most likely date. We found no formal call by 1 November. Deadlines differ: 14 November in elDiario.es, 12 November in Expansión.

On press counts, PP, Vox and Junts hold 34 seats, the left-wing groups 34, and the PNV one. October reports say the PNV backs 29/2026 and opposes 28/2026, though elDiario.es said on 5 October that its decision was not final. A rejected decree stops applying, and 28/2026 would never start if rejected before 15 November. After the October repeals, the consumer group OCU said effects already produced are not erased.

What the parties say

We found no final programmes by 1 November. These are reported positions, not law, largest parties first, from Fotocasa (14 October) unless stated. The list is not complete.

  • PP: party sources told El Español on 13 October it would vote against the decrees and repeal them if it wins. Its plan, reported on 22 October, would repeal the Housing Law and stressed areas and add a rent guarantee fund.
  • PSOE: on 6 October Sánchez asked groups to validate both decrees. It wants to develop the Housing Law and expand public housing.
  • Vox: repeal the Housing Law, free up land and speed up evictions (Infobae, 8 October).
  • Frente Amplio: its campaign spokesperson calls the election a referendum on the right to housing (Onda Vasca, 22 October). Sumar backs automatic renewal.
  • Junts: extensions only by agreement and a temporary 15% tax deduction for tenants.
  • PNV: protect vulnerable households without automatic renewal for small landlords.
  • Podemos: indefinite leases and rents cut by law.

What it means in Mallorca

  • Tenants: the extension and the cap apply here as national law.
  • Landlords: the temporary let rules apply now. If validated, the VAT reaches 26,143 Balearic properties, according to the Majorca Daily Bulletin, which Ultima Hora gives as the registered holiday homes. Balearic holiday-let rules are not changed by these decrees.
  • Buyers: 29/2026 creates state first-home loans for the lower of 20% of value or €50,000, with a permanent resale price limit. Details are pending. Under 28/2026, if it takes effect, a buyer who takes over a lease also takes on the compensation duty.

The Balearic government has declined to declare stressed areas, so measures tied to them, such as the tourist-let IBI surcharge, do not apply here for now. On 6 October vice-president Antoni Costa called the decrees an abuse of law, and the Govern was reported to be considering a Constitutional Court challenge. PSIB said the earlier decrees mattered especially here. PP and Vox rejected them.
